Electric Boat Sharing Terms and Conditions
- AZURESCAPE'S OBLIGATIONS
Article 1 – Purpose
AzurEscape provides one or more boats (hereinafter: the "Boat") for a fee, according to a schedule and price determined on the website www.azurescape.ch.
Article 2 – Usage Schedule
The Boat's usage schedule is established exclusively by AzurEscape via the website. AzurEscape reserves the right to modify schedules for technical, maintenance, safety, or weather reasons.
Article 3 – Insurance
AzurEscape has insurance covering damages with a CHF 1,000 deductible per claim to be paid by the Client.
Article 4 – Security Deposit
A security deposit equivalent to the deductible is required. It is held without interest and returned upon written request at the end of the season, provided there are no claims or outstanding debts to AzurEscape.
The security deposit will be collected by AzurEscape before the first boat trip for hourly rentals and at the start of the season for subscriptions.
In the event of non-renewal for three years, it will be retained by AzurEscape.
Article 5 – Claims and Damage
The Client is required to check the Boat's condition before each use. Any anomaly must be reported immediately. Otherwise, the Client is deemed responsible for any damage found after use. The propeller is not insured.
- CLIENT OBLIGATIONS
Article 6 – Setup Fees and Access (for 'subscription' clients)
The "subscription" Client shall pay setup fees of CHF 250 as well as a marina access badge fee of CHF 100.
Article 7 – Electricity
For the 2026 season, electricity consumed during the use of the Boat is included in the service.
Article 8 – Use of the Boat
The Client agrees to respect the booking times, return the Boat to its mooring, keep the Boat clean and in good condition (specifically emptying trash), return the Boat to its original state after use, and not bring any animals on board.
Article 9 – Modifications and Repairs
The Client is not authorized to make any modifications or repairs to the Boat or to hire a third party without prior authorization from AzurEscape.
Article 10 – Penalties
Any violation of contractual obligations will result in a penalty of CHF 500 per incident, in addition to the repair of any damage.
Article 11 – Liability
The Client is solely responsible for the use of the Boat. They guarantee that they hold a valid boating license, will respect weather conditions, and have personal liability insurance.
A valid boating license and proof of liability insurance may be required by AzurEscape before boarding.
- BATTERY AND ELECTRIC NAVIGATION
Article 12 – Range
The Client agrees to monitor the battery level and respect the defined navigation zones. The Boat must be returned with a sufficient charge level.
Article 13 – Charging
Charging, which must be previously authorized by AzurEscape, must be carried out exclusively at authorized charging stations using the equipment provided. Any non-compliant use is the responsibility of the Client.
Article 14 – Maintenance and Proper Use
It is forbidden to wet or spray the battery compartment, place objects in it, or tamper with it. The Client must immediately report any electrical alerts, abnormal noises, or loss of power.
Article 15 – Breakdowns
In the event of a breakdown due to improper use, the costs are the responsibility of the Client. In the event of a technical defect, AzurEscape will cover the intervention.
Article 16 – Environmental Responsibility
It is strictly forbidden to throw any part of the electrical system into the water. Any negligence resulting in pollution is the responsibility of the Client.
- RANGE AND EXPERIENCE
Article 17 – Managed Range
The Boat's range is defined to allow for optimal navigation. It may vary depending on weather conditions, lake state, navigation style, and the number of passengers.
Article 18 – Piloting and Guidance
The Boat features an interface to monitor energy levels in real time. The Client agrees to adopt a smooth navigation style and follow the recommendations provided.
Article 19 – Energy Management
The Boat may automatically adjust its performance to preserve range and ensure a safe return.
Article 20 – Client Commitment
The Client adopts a fluid, respectful navigation style, attentive to the environment and other users.
Article 21 – Spirit of Service
AzurEscape is committed to offering an elegant, sustainable, and controlled experience, based on quality of service and trust.
- FINAL PROVISIONS
Article 22 – Duration
The contract is valid from June 1 to October 31, 2026.
Article 23 – Termination
AzurEscape may terminate the contract at any time, with or without cause. In the event of fault by the Client, no refund is due.
Article 24 – Limitation of Liability
AzurEscape's liability is limited to the amount paid by the Client.
Article 25 – Governing Law and Jurisdiction
This contract is subject to Swiss law. The exclusive place of jurisdiction is Geneva.
